Boy is sued over golf-club incident

HARRISBURG — A minor boy is suing Kyle Costello, alleging negligence and insufficient measures taken to prevent injuries when the two boys, then 11, were in a physical education class.

Dominic Corbacio, a minor, by Jarrod Corbacio and Tamara Corbacio, his parents and natural guardians, filed a complaint on June 27 in the U.S. District Court for the Middle District of Pennsylvania against Costello, alleging that the defendant swung his golf club carelessly, causing injuries to Dominic Corbacio.

According to the complaint, the plaintiff alleges that on May 6, 2013, he sustained serious physical injuries when he was struck by a golf club during his class. The plaintiff holds Costello responsible because the defendant allegedly failed to exercise caution when swinging his golf club.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $300,000. He is represented by James C. Haggerty of Haggerty, Goldberg, Schleifer & Kupersmith, P.C. in Philadelphia.
