Employer sues union over filing of grievance

PITTSBURGH — An employer is suing the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union, AFL-CIO-CLC, citing alleged breach of contract.

Cenveo Corporation filed a complaint on June 29 in the U.S. District Court for the Western District of Pennsylvania against the defendant, concerning the union's filing of a grievance to challenge the termination of Dontay Stokes.

According to the complaint, the plaintiff alleges that Cenveo Corporation suffered damages as a result of a grievance being filed against its decision to terminate Stokes. The plaintiff holds the union responsible because it allegedly insists that the grievance it filed against the plaintiff is arbitrable.

The plaintiff seeks declare judgment against the defendant stating that the May 4, 2016 grievance is not arbitrable, enjoin the defendant, court costs and any further relief this court grants. They are represented by Q. Todd Dickinson, Jon A. Bierman, and Mark W. Weisman of Polsinelli PC in Washington , DC.
