Union funds claim company didn't make payments

HARRISBURG — Union trust funds and their trustee are suing Control Temp Insulation LLC, an employer, citing alleged breach of contract for faling to make union fund contributions.

William McGee, as trustee of the Insulators Local No. 23 Pension Fund, Insulators Local No. 23 Annuity Fund and Insulators Local No. 23 Health and Welfare Fund, filed a complaint on July 5 in U.S. District Court for the Middle District of Pennsylvania against Control Temp Insulation LLC, alleging that the employer failed to pay monthly contributions to union funds.

According to the complaint, the plaintiffs allege that the funds sustained damages as the result of unpaid contributions. The plaintiffs hold the defendant responsible because it allegedly failed to pay the plaintiffs on behalf of their employees under a collective bargaining agreement.

The plaintiffs seek judgment against the defendant, all contributions due to plaintiffs, liquidated damages, interest, $400, $137.50 as fees incurred in this action, attorney's fees and any further relief the court grants. They are represented by Charles W. Johnston of Charles W. Johnston, P.C. in Camp Hill.
