Employer accused of not paying into union funds

HARRISBURG — A lawsuit filed by union trust funds against Environmental Construction Services Inc. alleges breach of contract.

Warren Faust and Lori Eshenaur, as trustees of the Sheet Metal Workers Local 44 Retirement Income Plan, Sheet Metal Workers Local 44 Annuity Fund, Sheet Metal Workers Local 44 Welfare Fund and Sheet Metal Industry Education Fund, filed a complaint on July 6 in the U.S. District Court for the Middle District of Pennsylvania against Environmental Construction Services Inc., alleging that the employer failed to pay contributions to the trust funds.

According to the complaint, the plaintiffs allege that the funds suffered monetary damages as a result of unpaid contributions. The plaintiffs holds Environmental Construction Services Inc. responsible because the defendant allegedly failed to pay monthly contributions to the trust funds on behalf of its employees.

The plaintiffs seek contributions due, liquidated damages and interest, $400 filing fee and service fees of $137.50, and any further relief the court grants. They are represented by Charles W. Johnston of Charles W. Johnston, P.C. in Camp Hill.
