Widow seeks insurance benefit following husband's death

PITTSBURGH — A widow is suing the Reco Equipment Inc Employee Welfare Benefit Plan and Reliance Standard Life Insurance Company, a plan administrator and insurance firm, citing alleged breach of contract and improper denial of accidental death insurance benefits.

Linda L. Moore, surviving spouse and beneficiary of Tynan Moore, filed a complaint on July 8 in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging that they wrongly denied the plaintiff's benefit claim.

According to the complaint, the plaintiff alleges that she suffered damages from not being granted the benefits due for the death of her husband. The plaintiff holds the defendants responsible for allegedly wrongly asserting that the death was contributed to by alcoholism despite having sufficient evidence to prove that the cause of the death was accidental.

The plaintiff requests a trial by jury and seeks the full amount of the accidental death benefit plus interest, court costs and any further relief the court grants. She is represented by John W. McTiernan of Caroselli Beachler McTiernan & Coleman, LLC in Pittsburgh.
