Estate administrator seeks payment for disability benefits

PHILADELPHIA — An administrator of a deceased man's estate is suing Life Insurance Company of North America, alleging violation of the Employee Retirement Income Security Act.

Louise Swain, administrator for the estate of Jonathan C. Barton, filed a complaint on July 14 in the U.S. District Court for the Eastern District of Pennsylvania against Life Insurance Company of North America, alleging that the insurance firm denied Barton's application for long-term disability benefits.

According to the complaint, the plaintiff alleges that in 2014, Barton became disabled and was initially paid benefits that were later terminated. The plaintiff holds Life Insurance Company of North America responsible because the defendant allegedly improperly denied disability benefits despite Barton remaining disabled according to the terms of the plan.

The plaintiff seeks an order for the defendant to pay past-due benefits, interest, court costs and any further relief the court grants. She is represented by Joseph Capitan of Martin Law in Philadelphia.
