New Zealand school claims copyright infringement

PITTSBURGH — An New Zealand educational institution is suing Sportswear Inc., d/b/a Prep Sportswear, a Seattle-based corporation, citing alleged copyright infringement.

The University of Auckland filed a complaint on July 19 in the U.S. District Court for the Western District of Pennsylvania against Sportswear Inc., d/b/a Prep Sportswear, alleging that the corporation offers for sale products that bear the plaintiff's trademark.

According to the complaint, the plaintiff alleges that it suffered damages as the result of its trademark being used on products that it does not authorize. The plaintiff holds the defendant responsible because the defendant allegedly sells sportswear on its website that bears the plaintiff's trademark, creating the wrong impression among consumers that the defendants' goods are affiliated with plaintiff.

The plaintiff seeks judgment against the defendant for using its trademark, for all materials that contain infringing trademarks, for payment to the plaintiff of all profits derived from the unlawful act, payment of damages, treble damages, court costs and any further relief the court grants.
