PHILADELPHIA — A woman is suing Principal Life Insurance Company, citing alleged breach of contract and violation the Employee Retirement Income Security Act.
Susanna Cellini filed a complaint on July 25 in the U.S. District Court for the Eastern District of Pennsylvania against Principal Life Insurance Company, alleging that the insurer improperly denied her application for long-term disability benefits.
According to the complaint, the plaintiff alleges that she became disabled as the result of several medical conditions including multiple sclerosis and degenerative disc disease of the cervical and lumbar spine, and applied for disability benefits but was denied. The plaintiff holds the insurer responsible because the defendant allegedly denied her claim for long-term disability benefits despite her being disabled while the plan is in full effect and being disabled according to the terms of the plan, as well as having sufficient medical documents to support her claim.
The plaintiff seeks continuing benefits and all benefits in arrears, court costs, interest and any further relief this court grants. She is represented by Mary LeMieux-Fillery of The Law Offices of Eric A. Shore in Philadelphia.
