Employer accused of not paying contribution

PITTSBURGH — Labor union funds are suing Schaaf Excavating Contractors Inc., an employer, citing alleged breach of contract.

Laborers' Combined Funds of Western Pennsylvania, as agent for Philip Ameris, and Paul V. Scabilloni, trustees ad litem, Laborers' District Council of Western Pennsylvania Welfare and Pension Funds, the Construction Industry Advancement Program of Western Pennsylvania Fund and the Laborers' District Council of Western Pennsylvania and its affiliated local unions filed a complaint on July 25 in the U.S. District Court for the Western District of Pennsylvania against Schaaf Excavating Contractors Inc., alleging that the employer failed to pay its monthly contribution under an agreement.

According to the complaint, the plaintiffs allege that they suffered damages as the result of unpaid contributions. The plaintiffs holds the defendant responsible because it allegedly failed to submit an audit including wage deductions and monthly contributions on behalf of its employees to the labor group, per their agreement.

The plaintiffs seek an injunction against the defendant, an order for the defendant to file a complete report, money judgment in the sum of all amounts shown to be owed as a result of an audit, interest, liquidated damages/late charges, auditing fees and legal fees not less than $1,000, court costs and any further relief the court grants. They are represented by Jeffrey J. Leech and Neil J. Gregorio of Tucker Arensberg, P.C. in Pittsburgh.
