Rail worker claims violation of safety law

PHILADELPHIA — An employee is suing NJ Transit Rail Operations Inc., alleging violations of federal safety law.

Jerome C. Johnson filed a complaint on July 13 in the U.S. District Court for the Eastern District of Pennsylvania against NJ Transit Rail Operations Inc. alleging that the employer intentionally ordered the plaintiff to violate the Federal Railroad Safety Act regulations in order to get more work done.

According to the complaint, the plaintiff alleges that he suffered damages as the result of retaliation against him by his supervisor. The plaintiff holds NJ Transit Rail Operations Inc. responsible because the defendant allegedly retaliated and made threats to the plaintiff for reporting his supervisor's actions, which violates the FRSA.

The plaintiff requests a trial by jury and seeks expungement of all references to the disciplinary actions, compensatory damages, compensatory damages for economic losses, statutory and punitive damages, special damages and court costs. He is represented by Robert E. Myers and Lawrence A. Katz of Coffey Kaye Myers & Olley in Bala Cynwyd.
