PITTSBURGH — A man is suing Life Insurance Company of North America and Diebold Inc. Long-Term Disability Plan, alleging breach of contract and violation of the Employee Retirement Income Security Act.
James Neal filed a complaint on July 29 in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging that they improperly terminated his disability benefits.
According to the complaint, the plaintiff alleges that on Feb. 6, 2013, he became disabled and was initially being paid disability benefits until they were terminated on May 7, 2015. The plaintiff holds the defendants responsible for allegedly denying further payment of his disability benefits despite having adequate proof of his disability.
The plaintiff seeks a declaration that the defendant is obligated to pay plaintiff past-due long-term disability benefits, an award of retroactive long-term disability benefits and reinstatement of future benefits, court costs and any further relief the court grants.
