HARRISBURG — A West Virginia roofing company is suing Pennsylvania company Lobar Associates Inc. and Missouri-based Arch Insurance Company, citing alleged breach of contract and failure to pay for completed work.
Kalkreuth Roofing and Sheet Metal Inc. filed a complaint on Aug. 8 in the U.S. District Court for the Middle District of Pennsylvania against the defendants, alleging that they failed to pay plaintiff for a balance owed.
According to the complaint, the plaintiff alleges that Kalkreuth Roofing and Sheet Metal Inc. suffered damages from lack of payment for labor and materials. The plaintiff holds the defendants responsible because of its allegation that neither the company that received the benefit of the labor and materials – Lobar – nor the company that issued surety bonds in connection with the work – Arch – have paid the amount due.
The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount in excess of $75,000 plus interest and any further relief the court grants. They are represented by Sharon M. Menchyk of Blumling & Gusky, LLP in Pittsburgh.
