HARRISBURG — A Pennsylvania company is suing Rustique Specialty Gifts LLC, alleging unfair competition.
Jamie Flack LLC, d/b/a Rustique, filed a complaint on Aug. 12 in the U.S. District Court for the Middle District of Pennsylvania against Rustique Specialty Gifts LLC alleging that the Pennsylvania-based defendant uses the plaintiff's trademark in promoting its products and services.
According to the complaint, the plaintiff alleges that it has suffered damages to its business due to its trademark being used without authority. The plaintiff holds Rustique Specialty Gifts LLC responsible because the defendant allegedly used a confusingly similar name to the plaintiff for its gift shop in order to deceive customers.
The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's trademark, an award of profits and actual damages to the plaintiff as the result of the infringement, punitive damages, court costs and interest, and any further relief the court grants.
