Man says he was misclassified in bid to avoid overtime pay

PHILADELPHIA — An employee is suing U-Haul International Inc., Collegeboxes LLC and eMove Inc., alleging violation of the Fair Labor Standards Act, the Pennsylvania Minimum Wage Law and the Pennsylvania Wage Payment and Collection Law.

Michael Kauffman filed a complaint on Aug. 22 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that he was misclassifed as an independent contractor.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week without being paid any overtime wages. The plaintiff holds the defendants responsible for allegedly misclassifying him in order to avoid paying him any overtime wages.

The plaintiff requests a trial by jury and seeks compensatory damages, actual damages, injunctive and declaratory relief, liquidated damages, interest, court costs and any further relief the court grants.
