Woman claims wrongful termination after FMLA leave

Wrongful term 10

HARRISBURG — A former employee is suing Cetera Financial Group d/b/a ESSA Investment Services, ESSA Bank and Trust and Gary Olsen, citing alleged violation of the Family and Medical Leave Act and wrongful termination.

Joan Larsen filed a complaint on Aug. 23 in the U.S. District Court for the Middle District of Pennsylvania against the defendants, alleging that they terminated the plaintiff's employment for going on FMLA leave.

According to the complaint, the plaintiff alleges that in 2015, she began experiencing health issues related to a disability and exercised her rights for FMLA, and upon returning her employment was terminated. The plaintiff holds the defendants responsible because they allegedly started to harass the plaintiff upon returning from FMLA and ultimately terminated her employment.

The plaintiff requests a trial by jury and seeks an order to enjoin and restrain the defendants, back pay in the amount of wages and fringe benefits, front pay, compensatory damages, liquidated damages, punitive damages, court costs and any further relief the court grants. She is represented by Stephanie J. Mensing of Mensing Law LLC in Philadelphia.
