Cell phone distraction alleged as cause of collision

PHILADELPHIA — A couple's lawsuit against motorist Kevin P. Barron alleges negligence and insufficient measures taken to prevent injuries.

Eric Schmidt and Julie Schmidt filed a complaint on Aug. 26 in the U.S. District Court for the Eastern District of Pennsylvania against Barron, alleging that he failed to properly control his vehicle.

According to the complaint, the plaintiffs allege that on Aug. 13, 2015, Eric Schmidt sustained physical injuries in a collision. The plaintiffs hold Barron responsible because he allegedly was using his cell phone while operating his motor vehicle and failed to stop, causing his vehicle to strike the plaintiffs' car.

The plaintiffs request a trial by jury and seek judgment in an amount in excess of $75,000.
