PHILADELPHIA -- A Pennsylvania juice company is suing a Georgia competitor, disputing a claim of trademark infringement.
Smart Juices LLC filed a complaint on Sept. 22 in the U.S. District Court for the Eastern District of Pennsylvania against Grow Smart Kids LLC, alleging the company incorrectly claimed infringement by the plaintiff.
According to the complaint, the plaintiff alleges that Smart Juices LLC suffered damages to its business as the result of being accused of trademark infringement. The plaintiff holds Grow Smart Kids LLC responsible because the defendant allegedly ceased to use the mark "Grow Smart Kids" but alleges that the plaintiff's use of the mark is causing confusion among consumers.
The plaintiff requests a trial by jury and seeks a declaration that its use of the mark does not cause any confusion, an order for the order the U.S. Patent and Trademark Office to cancel the defendant's trademark registration, court costs and any further relief the court grants.
