City of Pittsburgh, rental owner blamed for hazardous sidewalk condition

PITTSBURGH — A married couple's lawsuit against Michael Episcopo, who owns a rental house, and the City of Pittsburgh alleges negligence in connection with a fall on an uneven sidewalk.

Michelle Corey and Paul Corey filed a complaint on Sept. 20 in the Court of Common Pleas of Allegheny County against the defendants, alleging that they failed to properly maintain the sidewalk that was broken apart by tree roots.

According to the complaint, the plaintiffs allege that on April 18, Michelle Corey sustained physical injuries when she tripped and fell. The plaintiffs hold Michael Episcopo and the City of Pittsburgh responsible because the defendants allegedly failed to provide adequate warning to pedestrians regarding the hazardous condition of the sidewalk caused the by roots of the tree.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount in excess of the jurisdictional limits of the court plus court costs and interest. They are represented by Deanna Lyn Liptak of Ainsman Levine, LLC in Pittsburgh.
