Life Insurance Company of North America accused of wrongly denying benefits

Insurance 08

PHILADELPHIA -- A man is suing an insurer, alleging breach of contract in the denial of long-term disability benefits.

Scott Lawhorne filed a complaint on Sept. 29 in the U.S. District Court for the Eastern District of Pennsylvania against Life Insurance Company of North America, alleging the insurer improperly denied his claim for long-term disability benefits.

According to the complaint, the plaintiff alleges that in 2008 he became disabled due to several medical conditions and was initially being paid disability benefits until they were terminated.

Lawhorne holds Life Insurance Company of North America responsible because the defendant allegedly upheld its decision to terminate the plaintiff's disability benefits despite him being disabled according to the terms of the plan.

The plaintiff seeks all benefits due plus interest, an order that he is entitled to receive benefits for as long as he remains disabled, all court costs and any further relief the court grants.

He is represented by Justin C. Frankel and Jason A. Newfield of Frankel & Newfield PC in Garden City, New York.
