HARRISBURG, Pa. -- A man is suing his employer, Delaware and Hudson Railway Company Inc. d/b/a CP Rail System, citing alleged hostile work environment, liability and negligence.
Damion Scales filed a complaint on Oct. 3 in the U.S. District Court for the Middle District of Pennsylvania against the defendant, alleging the employer failed to provide a safe working environment.
According to the complaint, the plaintiff alleges that on Feb. 1, 2015 he suffered severe physical injuries from slipping on a freezing surface and falling onto a rail switch stand, after being ordered to work in dangerous conditions over his objections. The plaintiff holds Delaware and Hudson Railway Company Inc. d/b/a CP Rail System responsible because the defendant allegedly failed to remove snow and ice and failed to provide a safe work area.
The plaintiff requests a trial by jury and seeks judgment against the defendant for all damages plus interest and court costs.
