Thermomagnetics & Cryogens Inc. accused of hiring man who violated agreement

PITTSBURGH — A Pennsylvania company is suing Sean Mykleby and Thermomagnetics & Cryogens Inc., based in California, citing alleged breach of contract and tortious interference.

Pittsburgh Universal LLC d/b/a Cool Pair Plus filed a complaint on Oct. 7 in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging that Sean Mykleby breached a contractual agreement with the plaintiff by taking the plaintiff's confidential information.

According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds the defendants responsible because Mykleby  allegedly accepted employment with the plaintiff's competitor in breach of his agreement with the plaintiff.

The plaintiff seeks an injunction against the defendant, a requirement for the defendant to preserve and avoid tampering with the hard drives of its computers, compensatory damages plus interest, court costs, double damages, and any further relief the court grants. It is represented by Kenneth S. Kornacki and Justin Barron of Metz Lewis Brodman Must O'Keefe LLC in Pittsburgh.
