Navient Solutions accused of violating telephone laws

Phone 08

PITTSBURGH — Two people are suing Navient Solutions Inc., aka Sallie Mae, and Does 1-10, alleging violation of telephone harassment statutes.

Joseph and Nicole Messina filed a complaint on Oct. 10 in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging that they called the plaintiffs cellular telephone to collect an alleged consumer debt.

According to the complaint, the plaintiffs allege that in June, they sustained damages from receiving numerous collection calls despite their request for the calls to stop. The plaintiffs hold the defendants responsible for allegedly using a pre-recorded or artificial voice to contact the plaintiffs.

The plaintiffs request a trial by jury and seek statutory damages of $500, treble damages and any further relief the court grants. They are represented by Jody B. Burton of Lemberg Law, L.L.C. in Wilton, Connecticut.
