PHILADELPHIA — A Delaware corporation is suing Lafrance Corp., a Pennsylvania corporation, citing alleged negligent misrepresentation and unfair competition.
Zippmark Inc. filed a complaint on Oct. 12 in the U.S. District Court for the Eastern District of Pennsylvania against Lafrance Corp. alleging that the Pennsylvania corporation used the plaintiff's trademarked shape on its lighters.
According to the complaint, the plaintiff alleges that it suffered damages to its business and reputation from having its trademarked design used on a competitor product. The plaintiff holds Lafrance Corp. responsible because the defendant allegedly ignored the plaintiff's cease-and-desist letter and continued to use the plaintiff's design.
The plaintiff requests a trial by jury and seeks all damages, enhanced damages, punitive damages, court costs and interest and any further relief the court grants. It is represented by Theresa E. Loscalzo and Amey J. Park of Schnader Harrison Segal & Lewis LLP in Philadelphia.
