Vizio accused of misrepresenting energy efficiency of televisions

PITTSBURGH — A consumer has filed a class-action lawsuit against Vizio Inc., a television manufacturer, citing alleged fraud and negligent misrepresentation.

James Unice filed a complaint on Oct. 12 in the U.S. District Court for the Western District of Pennsylvania against Vizio Inc., alleging that the television manufacturer made false claims regarding the energy efficiency of its televisions.

According to the complaint, the plaintiff alleges that he suffered damages from being misled into purchasing a falsely advertised television. The plaintiff holds Vizio Inc. responsible because the defendant allegedly failed to properly inform the consumers that the power saving mode of the television automatically disables whenever any picture settings are changed.

The plaintiff requests a trial by jury and seeks to forbid the defendant from destroying any records that could serve as evidence, statutory damages, punitive damages, compensatory damages, restitution, declaratory and injunctive relief, a corrective advertising campaign, court costs and any further relief the court grants.
