HARRISBURG – Labor funds are suing Suburban Tile and Stone LLC, alleging breach of contract.
Lester W. Kauffman, III, as Trustee of the Union Trowel Trades Benefit Funds of Central Pennsylvania; James Boland, as Trustee of the Bricklayers and Trowel Trades Electronically Filed International Pension Fund and International Masonry Institute; Joseph J. Davis, as Trustee of the International Union of Bricklayers and Allied Craftworkers Local #15 PA Pension Fund; Jack Figured, as Trustee of the Bricklayers & Stonemasons Local 5 Annuity Fund; and George Hardy, as Trustee of the PA Local 47 Bricklayers and Allied Craftsmen Pension Plan filed a complaint on Oct. 14 in the U.S. District Court for the Middle District of Pennsylvania against Suburban Tile and Stone LLC, alleging that the employer failed to make their monthly contributions to the labor group.
According to the complaint, the plaintiffs allege that they suffered damages from unpaid and late paid contributions. The plaintiffs hold Suburban Tile and Stone LLC responsible because the defendant allegedly breached a bargaining agreement with the plaintiffs by failing to make monthly contributions on behalf of employees.
The plaintiffs seek funds, payroll records, court costs and any further relief the court grants. They are represented by Charles W. Johnston of Charles W. Johnston, P.C. in Camp Hill.
