Man claims Indiananapolis Colts' app could listen to conversations

PITTSBURGH — A man has filed a class-action lawsuit against Lisnr Inc., Yinzcam Inc. and Indianapolis Colts Inc., alleging invasion of privacy.

Alan Rackemann filed a complaint on Oct. 14 in the U.S. District Court for the Western District of Pennsylvania against the defendants alleging that they developed an app that could listen to conversation through the use of a smartphone.

According to the complaint, the plaintiff alleges that he suffered damages from having his privacy compromised through the use of a mobile app. The plaintiff holds the defendants responsible because they allegedly knew about the app's ability to activate the microphone on the plaintiff's smartphone and listen to conversations but did not inform the plaintiff or the general public regarding this feature.

The plaintiff requests a trial by jury and seeks statutory damages, actual damages, profits, punitive damages, injunctive relief, interest, court costs and any further relief this court grants. He is represented by David S. Senoff and Anapol Weiss of Anapol Weiss in Philadelphia.
