Nuway Scaffolding accused of not paying contributions

PITTSBURGH — A labor fund is suing Nuway Scaffolding LLC, citing alleged breach of contract.

Carpenters Combined Funds Inc. filed a complaint on Oct. 17 in the U.S. District Court for the Western District of Pennsylvania against Nuway Scaffolding LLC, alleging that the employer failed to pay monthly contributions to the labor group.

According to the complaint, the plaintiff alleges that it sustained damages from unpaid and late paid contributions. The plaintiff holds Nuway Scaffolding LLC responsible because the defendant allegedly breached its agreement with the plaintiff for refusing to pay benefit contributions on behalf of employees.

The plaintiff seeks immediate payment of all monies past due, an order for the defendant to file a complete and accurate remittance report, money judgment in the sum of $95,247.86, liquidated damages, attorneys' fees of 20 percent of the total amount due, court costs and any further relief the court grants.
