Wesco Insurance Company claims failure to properly indemnify

PHILADELPHIA — An insurance firm is suing Penn National Security Insurance Company, d/b/a Penn National Insurance, citing alleged breach of duty and unjust enrichment.

Wesco Insurance Company filed a complaint on Oct. 19 in the U.S. District Court for the Eastern District of Pennsylvania against the defendant, alleging it failed to properly indemnify its insured party in a workplace injury case.

According to the complaint, the plaintiff holds the defendants responsible for allegedly failing to perform their defense obligation.

The plaintiff requests a trial by jury and seeks defense costs, court costs and any further relief the court grants. They are represented by Gale White and Frank J. Perch III of White and Williams LLP in Philadelphia.
