Duryea man allegedly injured on Trader Joe's job because of unsafe scaffolding

SCRANTON – A Duryea couple alleges the husband was injured while working because of unsafe scaffolding provided for the job.

James J. Wylam and Janice L. Wylam filed a complaint on Oct. 19 in the U.S. District Court for the Middle District of Pennsylvania against Trader Joe's Co., Trader Joe's East Inc., T.A.C.T. Holding Inc. and World Class Distribution Inc. alleging negligence.

According to the complaint, James J. Wylam was employed by Southeast Personnel Leasing Co. and assigned to work for Full Steam Staffing at the defendants' Nazareth location. The plaintiffs allege that on Oct. 19, James J. Wylam sustained serious physical injuries to his head when the guard rail of the scaffolding broke loose while he was working, causing him to fall. The plaintiffs holds Trader Joe's Co., Trader Joe's East Inc., T.A.C.T. Holding Inc., and World Class Distribution Inc. responsible because the defendants allegedly failed to provide James Wylam safe tools and a safety harness to properly and safely perform his duties.

The plaintiffs request a trial by jury and seek judgment against the defendant in an amount that exceeds the jurisdictional limits of the court plus interest and court costs. They are represented by Jill Kelly McComsey of Seidel, Cohen, Hof & Reid LLC in Bethlehem.
