Consumer alleges credit agencies list inaccurate statements on credit report

PHILADELPHIA – A Philadelphia consumer claims inaccurate information is on his credit report.

Benjamin Ochieng filed a complaint on Nov. 14 in the U.S. District Court for the Eastern District of Pennsylvania against the Trans Union LLC, Equifax Information Systems LLC, Experian Information Solutions Inc. and JH Portfolio Debt Equities citing the Fair Credit Reporting Act and the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that he became delinquent on a Visa credit card in 2008 and because more than seven years have passed, no information regarding the card should be reported. He also alleges that JH Portfolio Debt Equities is attempting to collect on the debt despite the fact it is beyond its statute of limitations.

The plaintiff holds Trans Union LLC, Equifax Information Systems LLC, Experian Information Solutions Inc. and JH Portfolio Debt Equities responsible because the defendants allegedly failed to properly investigate plaintiff's dispute and continue to report inaccurate information to third parties.

The plaintiff requests a trial by jury and seeks actual damages, statutory damages, punitive damages, court costs and any further relief the court grants. He is represented by Richard Kim, Kevin Kotch and Drucilla Tigner of The Kim Law Firm LLC in Philadelphia.
