Property owner claims state failed to ensure proper drainage on its property

PITTSBURGH — An individual is suing the state Department of Transportation, citing alleged insufficient measures were taken to prevent injuries and negligence.

Darryl Buchlmayer filed a complaint on Oct. 21, in the Court of Common Pleas of Allegheny County against Commonwealth of Pennsylvania, Department of Transportation alleging that the government agency failed to make sure that the water from their property would not drain into adjacent properties.

According to the complaint, the plaintiff alleges that he sustained water damage to his property. The plaintiff holds Commonwealth of Pennsylvania, Department of Transportation responsible because the defendant allegedly failed to properly construct the drain of their property to make sure that it won't flow into plaintiff's property.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $35,000 plus interest and court costs. He is represented by Walter J. Nalducci of Cutruzzula & Nalducci in Pittsburgh.
