PITTSBURGH -- An Allegheny County insurance company alleges a former employee is using confidential information to solicit the plaintiff's customers.

Henderson Bros. Inc. filed a complaint on Nov. 8 in the Court of Common Pleas of Allegheny County against Mark Burns, Arthur J. Gallagher & Co. Inc. and Arthur J. Gallagher & Co. of Pennsylvania Inc. alleging breach of contract and other counts.

According to the complaint, the plaintiff alleges Burns was a former employee hired by Gallagher in January. The plaintiff holds Burns, Arthur J. Gallagher & Co. Inc. and Arthur J. Gallagher & Co. of Pennsylvania Inc. responsible because Burns allegedly breached his contractual obligation with the plaintiff by acquiring sensitive information about its business and using it to solicit from its customers.

The plaintiff requests a trial by jury and seeks injunction against the defendants, actual damages, consequential damages, punitive damages, court costs and any further relief the court grants.

It is represented by Henry M. Sneath, Robert Wagner and Amber L. Reiner of Picadio Sneath Miller & Norton PC in Pittsburgh.
