Chartiers Community Health accused of retaliation over FMLA leave

PITTSBURGH — An employee is suing Chartiers Community Health, alleging retaliation and violation of the Family and Medical Leave Act.

Nancy Adkins of East Liverpool, Ohio, filed a complaint on Nov. 16 in the Court of Common Pleas of Allegheny County against Chartiers Community Health of Bridgeville, alleging that the employer forced the plaintiff to accept a demotion or resign.

According to the complaint, the plaintiff alleges that she suffered from a number of physical disabilities and had to take a six-day leave for kidney stones, and upon her return to work she was forced into the position of taking a demotion in order to keep from losing her employment. 

The plaintiff holds Chartiers Community Health responsible because the defendant allegedly retaliated against the plaintiff for exercising her FMLA rights.

The plaintiff requests a trial by jury and seeks judgment against the defendant for loss of back wages, front pay, wages and other benefits, liquidated damages, court costs and any further relief this court grants. She is represented by Elizabeth Pollock-Avery of Kraemer, Manes & Associates LLC in Pittsburgh.
