Celtic Homecare, others accused of violating FMLA

PITTSBURGH — A nurse is suing parties connected with her former employer, alleging that she was terminated in violation of the Family and Medical Leave Act.

Joyce Breghenti filed a complaint on Nov. 23 in the Court of Common Pleas of Allegheny County against Allegheny Health Network; JC Holdco LLC; Celtic Homecare Inc. f/k/a Celtic Healthcare Inc.; Celtic Healthcare of Westmoreland LLC; Celtic Hospice & Palliative Care Services LLC; Allegheny Health Network Healthcare at Home Home Health; Allegheny Health Network Healthcare at Home Hospice & Palliative Care; and Tanya Miller, Vice President of Home Health at Celtic Homecare Inc. f/k/a Celtic Healthcare Inc., alleging that the plaintiff was fired for exercising her rights under the FMLA.

According to the complaint, the plaintiff alleges that she suffered damages from being terminated after going on a weeklong FMLA leave – a period she had already scheduled as a vacation – in connection with her kidney disease. The plaintiff alleges the defendants are responsible for wrongly terminating her on grounds that she was unwilling or unable to work enough hours to do her job, and she also claims they wrongly failed to pay her a promised bonus.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount that exceeds $35,000, damages, benefits, interest, liquidated damages, court costs and any further relief this court grants.
