El Campesino Mexican Restaurant accused of violating wage laws

PITTSBURGH — A lawsuit filed under the tenure of the former U.S. secretary of labor against FGMA Inc., doing business as El Campesino Mexican Restaurant, Felix Gutierrez and Maurillo Alva alleges that the Altoona restaurant violated the Fair Labor Standards Act.

Thomas E. Perez, in his capacity as then-secretary of labor, filed a complaint on Jan. 9 in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging that they failed to pay their employees fair wages.

According to the complaint, the plaintiff alleges that the United States Department of Labor suffered damages on behalf of restaurant employees who were not properly compensated for their work. The plaintiffs holds the defendants responsible for alleged violations regarding minimum wage and overtime pay.

The plaintiffs seek enjoin the defendant, back wage compensation, and liquidated damages. They are represented by John A. Nocito of Office of the Solicitor in Philadelphia.
