PHILADELPHIA — An insurance company and its insured are suing Eckert Mechanical LLC, An Original Soft Pretzel Factory Inc., Illinois Tool Work Inc., ITW Food Equipment Group LLC and Baxter Manufacturing Co. Inc., with varying allegations against the defendants including product liability and negligence.
Merchants Mutual Insurance Company as subrogee of J. Powers LLC T/A West Chester Soft Pretzel and Philly Soft Pretzel Factory filed a complaint on Jan. 17 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that they installed and poorly maintained the pretzel which started a fire on plaintiff's property.
According to the complaint, the plaintiffs allege that, in January 17, 2015, West Chester Soft Pretzel and Philly Soft Pretzel Factory suffered fire damage to their property. The plaintiffs holds Eckert Mechanical, LLC, An Original Soft Pretzel Factory, Inc., Illinois Tool Work Inc., ITW Food Equipment Group, LLC and Baxter Manufacturing Co., Inc. responsible because the defendants allegedly installed a pretzel oven that caused the combustible flooring of plaintiff's store to ignite.
The plaintiffs request a trial by jury and seek judgment against the defendant in an amount that exceeds $75,000 plus interest and any further relief this court grants. They are represented by Vlad Kushnir of VB Kushnir, LLC in Philadelphia.
