HARRISBURG — A man is suing an alleged assailant and other defendants, claiming he was the victim of an attack by an intoxicated patron in a restaurant, resulting in severe injuries, hospitalization and facial reconstruction surgery.
Brooklyn, New York, resident Gabriel Snow filed a complaint on Jan. 17 in the U.S. District Court for the Middle District of Pennsylvania against Corey Roadcap, Frank Nash, John Doe, A&B Partnership and XYZ Corp. (fictitious names) t/d/b/a Frank's Trattoria and/or Frank's Pizza Trattoria and/or Frank's Pizza, John Does 1-10 (fictitious names), John Does 11-20, X&Y Partnership and ABC Corp., with varying allegations against the defendants including negligence, assault and battery, and violation of dram shop law.
According to the complaint, the plaintiff alleges that on Jan. 18, 2015, he suffered physical injuries from being attacked by New Market, Virginia, resident Roadcap inside Frank's Trattoria in Bloomsburg. The plaintiff holds the defendants responsible for varying allegations, including the alleged assault by Roadcap and other defendants' alleged action of serving alcohol to Roadcap despite his visible intoxication.
The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount that exceeds $75,000, statutory damages, compensatory damages, actual damages, court costs and punitive damages. He is represented by Aaron B. Gorodetzer of Sbarbaro Law Offices, LLC in West Chester.
