PHILADELPHIA — Union funds are suing Allan Briteway Electrical Contractors Inc. and William M. Brown c/o Allan Briteway Electrical Contractors Inc., New York companies, alleging breach of contract and breach of duty.

International Brotherhood of Electrical Workers Local Union No. 98 Health & Welfare Fund, International Brotherhood of Electrical Workers Local Union No. 98 Pension Plan, International Brotherhood of Electrical Workers Local Union No. 98 Profit Sharing Plan, Electrical Workers Joint Apprenticeship and Training Trust Fund, Local Union No. 98 Vacation Plan, and Labor Management Cooperative Committee and Local Union 98 of the International Brotherhood of Electrical Workers filed a complaint on Jan. 18 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that they failed to provide an accurate payroll audit to the plaintiff.

According to the complaint, the plaintiffs allege that they sustained damages from not being paid contractual deductions. The plaintiffs holds Allan Briteway Electrical Contractors Inc. and William M. Brown c/o Allan Briteway Electrical Contractors Inc. responsible because the defendants allegedly breached their bargaining agreement when they failed to remit amounts deducted from their employees' pay as contributions.

The plaintiffs seek judgment against the defendants in the amount of $53,760.26 for unpaid principal contributions plus interest, $182,029.02 in liquidated damages, court costs and any further relief this court grants. They are represented by William T. Josem and Jeremy E. Meyer of Cleary, Josem & Trigiani LLP in Philadelphia.
