R&M Masonry Contractors accused of not paying into funds

PHILADELPHIA — Union funds are suing R&M Masonry Contractors Inc. and Richard Lee, individually and as president and treasurer of R&M Masonry Contractors Inc., a Pennsylvania company and its president, citing alleged breach of contract.

Bricklayers & Allied Craftworkers Local 1 of PA/DE, Trustees of Bricklayers & Allied Craftworkers Local 1 of PA/DE Health & Welfarre Fund, Trustees of Bricklayers & Allied Craftworkers Local 1 of PA/DE Joint Apprentices & Training Fund, Trustees of Bricklayers & Allied Craftworkers Local 1 of PA/DE Vacation Fund, Trustees of Bricklayers & Allied Craftworkers Local 1 of PA/DE Annuity Fund, Trustees of Bricklayers & Allied Craftworkers Local 1 of PA/DE Pension Fund, and Trustees of Bricklayer & Trowel Trades International Pension Fund filed a complaint on Jan. 19 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that they failed to pay contributions to the funds.

According to the complaint, the plaintiffs allege that they sustained monetary damages from delinquent contributions. The plaintiffs hold the defendants responsible because they allegedly failed to submit reports and remit contributions to the union funds on behalf of their employees.

The plaintiffs seek delinquent principal contribution of $9,036.21 plus $896.33 as interest, $903.62 as liquidated damages, $77.82 in interest, $150.18 in liquidated damages, audit amount of $6,479.05, and order the defendant to remit employer contribution reports. They are represented by Robert P. Curley of O'Donoghue & O'Donoghue LLP in Philadelphia.
