PHILADELPHIA — An Upper Darby man is suing his former employer and direct supervisor, citing alleged retaliation and violation of the Family and Medical Leave Act (FMLA).
Anthony Fagan filed a complaint on Jan. 27, in the U.S. District Court for the Eastern District of Pennsylvania against
Elwyn Inc. and Ben Dourte,
alleging that they interfered with his rights for medical leave.
According to the complaint, Fagan alleges that he sustained damages from being terminated from employment for going on a medical leave from July 11, 2015, to July 22, 2015. The plaintiff holds Elwyn and Dourte responsible because they allegedly terminated his employment as retaliation for applying for intermittent leave of absence due to a medical condition.
Fagan seeks judgment against the defendant for compensatory damages, economic and non economic damages, court costs and any further relief this court grants. He is represented by Christopher J. Delgaizo of Kraemer Manes & Associates LLC in King of Prussia.
