Bucks County, Montgomery County residents say debt collector called relatives without consent

PHILADELPHIA — Two Bucks County residents and three Montgomery County residents are suing a debt collector, citing alleged violation of the Fair Debt Collection Practices Act.

Debra Miller, Jane Morley, Aisha Richardson, Scott Hanstein and Emma Smith filed a complaint on Jan. 25 in the U.S. District Court for the Eastern District of Pennsylvania against Midland Funding LLC and Midland Credit Management Inc. alleging that they called the plaintiffs using artificial or prerecorded voice to collect a debt.

According to the complaint, the plaintiffs allege that between 2014 and 2016, they sustained damages from receiving collection calls. The plaintiffs hold Midland Funding and Midland Credit Management responsible because they allegedly called the plaintiff's relatives to collect a debt without consent from the plaintiff.

The plaintiffs request a trial by jury and seek statutory damages, enjoin the defendant, statutory damages in the amount of $500 for each call made to the plaintiffs' cellphones, $1,500 for treble damages for each call made to the plaintiff's cellular telephone, actual damages, court costs and any further relief this court grants.
