Bensalem restaurant operator used music without permission, complaint alleges

PHILADELPHIA — Music production companies are suing a Bensalem restaurant operator, citing alleged copyright infringement.

Almo Music Corp., Bourne Co., Cromwell Music Inc. and Goo Eyed Music filed a complaint on Jan. 31 in the U.S. District Court for the Eastern District of Pennsylvania against Celebrations Plaza Inc., Marie R. Leporace and Joseph Leporace, alleging that they used the plaintiffs' musical compositions without an license.

According to the complaint, the plaintiffs allege that they sustained damages from having their musical compositions used without their authority. The plaintiffs hold Celebrations Plaza, Marie Leporace and Joseph Leporace responsible because they allegedly refused all attempts by the plaintiffs to offer them a license.

The plaintiffs seek enjoin the defendant and restrain them permanently from publicly performing plaintiffs' compositions, statutory damages between $750 and $30,000, court costs and any further relief this court grants. They are represented by Vincent V. Carissimi and Noah S. Robbins of Pepper Hamilton LLP in Philadelphia.
