Summa & Iezzi Inc. alleged to have not contributed to union funds

SCRANTON – The trustees of several labor union funds claim a Dunmore business has failed to pay monthly contributions.

Robert F. Pesotski and Jolene Sobeck, as trustees of the Laborers' Local No. 130 Pension Fund, Laborers' Local No. 130 Annuity Fund and Laborers' Local No. 130 Welfare Fund filed a complaint on Feb. 6 in the U.S. District Court for the Middle District of Pennsylvania against Summa & Iezzi Inc. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they sustained damages to the ERISA funds. The plaintiffs hold Summa & Iezzi Inc. responsible because the defendant allegedly failed to pay monthly contributions to the plaintiffs' funds on behalf of its employees.

The plaintiffs seek contributions due plus additional contributions, liquidated damages and interest in the amount of $6,374.01, additional liquidated damages and interest, court costs, filing fees of $400, service fees of $137.50, and any further relief the court grants. They are represented by Charles W. Johnston of Charles W. Johnston PC in Camp Hill.
