Summa & Iezzi Inc. accused of not making contributions to labor funds

HARRISBURG — Labor funds are suing Summa & Iezzi Inc., a Pennsylvania company, citing alleged breach of contract.

Lester W. Kauffman III and George D. Hardy, as trustees of the Union Trowel Trades Benefit Funds of Central Pennsylvania; Jack Figured and Carmen Esgro, as trustees of the Bricklayers & Stonemasons Local 5 Annuity Fund; Laine Gehres and George D. Hardy, as trustees of the PA Local 47 Bricklayers and Allied Craftsmen Pension Plan; and James Boland, as Ttustee of the Bricklayers and Trowel Trades International Pension Fund and International Masonry Institute, filed a complaint on Feb. 6 in the U.S. District Court for the Middle District of Pennsylvania against Summa & Iezzi Inc., alleging that the Pennsylvania company failed to pay monthly contributions due under a collective bargaining agreement.

According to the complaint, the plaintiffs allege that they suffered damages due to the alleged lack of payment. The plaintiffs holds Summa & Iezzi Inc. responsible because the defendant allegedly failed to pay funds on behalf of employees as required by the agreement.

The plaintiffs seek contributions, liquidated damages in the amount of $8,506.24, court costs, filing fees of $400 and service fee of $137.50, and any further relief this court grants. They are represented by Charles W. Johnston of Charles W. Johnston, P.C. in Camp Hill.
