Cleaning woman says she was infected by used scalpels, needles in trash cans

PITTSBURGH — An office cleaner is suing Carl Medgaus, DMD, Ltd. and Carl Medgaus, DMD d/b/a Medgaus Dental Care, alleging negligence in discarding scalpels and needles.

Yevett Wells filed a complaint in the Court of Common Pleas of Allegheny County against the defendants, alleging that they threw used scalpels and needles in the trash bin.

According to the complaint, the plaintiff alleges that on May 28, 2015, she suffered a laceration from a scalpel while removing trash from the Medgaus office, and since then has suffered multiple serious infections and undergone multiple surgeries, debridements and other procedures, and has also been unable to perform her usual work, as a result of the defendants' negligence. The plaintiff holds the defendants liable for the alleged failure to properly dispose of used scalpels and needles.

The plaintiff seeks judgment against the defendants in an amount that exceeds the arbitration limits of this court plus any further relief this court grants. She is represented by James R. Moyles of Moyles Law PC in Pittsburgh.
