Woman seeks reinstatement to position with AMTRAK

PHILADELPHIA – A former AMTRAK employee claim she was wrongfully terminated.

Ashley Millsip filed a complaint on Feb. 8 in the U.S. District Court for the Eastern District of Pennsylvania against National Railroad Passenger Corp., doing business as AMTRAK, citing the Federal Rail Safety Act.

According to the complaint, the plaintiff alleges that she suffered a back injury while working on Nov. 10, 2013, and was taken to the hospital by a co-worker without filling out an accident report. She alleges she was harassed by supervisors and the defendant's representatives to complete a report. The plaintiff holds National Railroad Passenger Corp. responsible because the defendant allegedly terminated the plaintiff in retaliation on March 26, 2016.

The plaintiff requests a trial by jury and seeks removal of all files relating to the plaintiff's termination and investigation, back pay and lost overtime wages plus interest, reinstatement, benefits, court costs and punitive damages of $250,000. She is represented by Michael P. Rausch of Deasey, Mahoney & Valentini LTD in Philadelphia.
