HARRISBURG — Nebraska companies are suing Pennsylvania-based defendants The McNaughton Company d/b/a McNaughton Homes and Midpenn Construction Co.; 441 McNaughton Properties LLC; Midpenn Properties Inc.; McNaughton Real Estate Group Inc.; David W. Shannon; Vicki R. Shannon; Francis J. McNaughton; and Mark McNaughton, citing alleged copyright infringement.
Design Basics LLC, Carmichael & Dame Designs, Inc., and Plan Pros Inc. filed a complaint on Feb. 10 in the U.S. District Court for the Middle District of Pennsylvania against the defendants, alleging that they copied the plaintiffs' architectural works.
According to the complaint, the plaintiffs allege that they sustained damages to their business. The plaintiffs hold the defendants responsible for allegedly reproducing and selling architectural works derived from the plaintiffs' designs.
The plaintiffs request a trial by jury and seek profits and revenue, actual damages, statutory damages, a permanent injunction against the defendants, court costs, impoundment of all house plans and elevations that infringe plaintiffs' copyrights, and any further relief this court grants.
