Akers National Roll Company Health & Welfare Benefits Plan accused of violating contract

PITTSBURGH — Labor representatives have filed a class action lawsuit against Ampco-Pittsburgh Corporation, Akers National Roll Company and Akers National Roll Company Health & Welfare Benefits Plan, citing alleged breach of contract.

Ronald A. Cup and Mark Greenawalt, United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union, AFL-CIO filed a complaint on Feb. 8 in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging that retirees' healthcare benefits were wrongly terminated.

According to the complaint, the plaintiffs allege that Ronald A. Cup, Mark Greenawalt and other retirees saw their benefits improperly terminated. The plaintiffs holds Ampco-Pittsburgh Corporation, Akers National Roll Company and Akers National Roll Company Health & Welfare Benefits Plan responsible because the defendants allegedly breached a contractual agreement.

The plaintiffs request a trial by jury and seek a declaration that the defendants have breached their obligation, an order for the defendants to restore the retiree health care benefits, an injunction against the defendants, monetary damages, restitution, reinstatement, court costs and any further relief this court grants. The plaintiffs are represented by Joel R. Hurt and Ruairi McDonnell of Feinstein Doyle Payne & Kravec LLC in Piitsburgh.
