Class action says firmware update damaged drones

SCRANTON — A Pennsylvania man has filed a class action lawsuit against two California technology corporations, alleging breach of contract.

Kevin Sives of Hawley, Pennsylvania, filed a complaint, individually and on behalf of all others similarly situated, Feb. 16 in U.S. District Court for the Middle District of Pennsylvania against DJU Technology, Inc. and DJI Service, LLC, alleging they released a firmware update that caused problems to their drones.

According to the complaint, Sives, who had purchased a Phantom 2 Drone for $1,169 in March 2015, sustained monetary damages from having his drone damaged by the firmware update. The plaintiff alleges the defendants refused to take responsibility for the drones that were damaged due to the firmware update or to provide users with a replacement of an offer to repair their drones.

Sives seeks trial by jury, all actual, general, special, incidental, statutory, punitive, and consequential damages, interest, court costs, and all further relief the court grants. He is represented by attorneys Joseph G. Sauder, Matthew D. Schelkopf and Joseph B. Kenney of McCune Wright Arevalo LLP in Berwyn.
