Gibsonia couple claim negligence by UPMC after wife's fall and brain injury

PITTSBURGH — A Gibsonia couple are suing UPMC and UPMC Passavant hospital, citing alleged insufficient measures were taken to prevent the wife's fall and subsequent brain injury while she was receiving care for another medical issue.

Stephanie A. Cox and Patrick C. Cox filed a complaint on Dec. 14 in the Court of Common Pleas of Allegheny County alleging that hospital personnel failed to provide proper care to Stephanie after she was taken by ambulance to UPMC Passavant McCandless on Sept. 9, 2014 after an unrelated health emergency at her home.

The complaint alleges that Stephanie fell from either her bed or stretcher shortly after arriving in the emergency department and was found on the floor with what was later diagnosed as a traumatic brain injury. The plaintiffs hold the defendants responsible because the hospital staff allegedly failed to provide adequate supervision and assistance to Stephanie to prevent her from falling from where she was resting.

The plaintiffs request a trial by jury and seek judgment against the defendant in an amount that exceeds the jurisdictional limits of this court plus interest, court costs and any further relief the court grants. They are represented by Peter D. Giglione of The Massa Law Group P.C. in Pittsburgh.
